The bill (Reg. No. 2650) suggests supplementing article 49 “Discharge from criminal liability due to limitation period” of the Criminal Code with part six and seven, presupposing termination of limitation period in case of electing or appointment to the post that under the Constitution of Ukraine gives him/her immunity from prosecution. Under these conditions, it is proposed to terminate and renew limitation period after a person has been deprived of immunity, or after he/she ceases to hold the relevant post.
The Committee members believe that the bill will improve the legal regulation of criminal responsibility in the case of election or appointment of a person to the post that under the Constitution of Ukraine gives him/her immunity from prosecution.
